NYPD Psychological Disqualification – One Chance to Appeal

As an NYPD disqualification appeals lawyer with over 20 years of experience, Kevin Sheerin has helped many candidates who failed their NYPD Psychologist Test and received either a Notice of Proposed Disqualification (NOPD) or Notice of Disqualification (NOD) from the NYPD.

In the NOPD letter, the disqualified candidate is given an opportunity to select a psychological expert and have their NYPD psychological file sent to that expert for review and preparation of a rebuttal report.  If a candidate does not respond TIMELY to the NOPD, the NYPD psychological file will NOT be released to their psychologist.

It is crucial that the disqualified candidate select AN EXPERIENCED psychologist familiar with the appeals process. ONCE A CANDIDATE SELECTS A PSYCHOLOGICAL EXPERT TO ASSIST THEM WITH THEIR APPEAL, THEY ARE GENERALLY NOT ABLE TO CHANGE THEIR CHOICE LATER.

Your Guide to the NYPD Hiring Process

After you have taken the exam, the NYC Department for Citywide Administration Services (DCAS) will generate your “list number”. Candidates who pass the exam will be given a list number as well as an exam score (meaning the higher your score, the lower your list number will be).

After you pass the exam, the NYPD’s Candidate Assessment Division will email you an invitation to create a NYPD Candidate Portal account. Through this Portal, you will be required to complete the Personal History Questionnaire, as this is where your assessment process begins. Additionally, you will be asked to prepare and upload additional documents through the Portal (which you can find at NYPD Candidate Portal (nypdonline.org)

When you go to your first interview, you will be required to bring and/or upload certain documentation. A list of the items you will be required to upload and/or bring will be listed on your NYPD Candidate Portal after you complete your Personal History Questionnaire.

You can expect the hiring process to take an average of 6 months to 1 year to be hired. In rare cases the process can take as little as 2 months or as long as 4 years depending upon each candidate’s situation. Your exam is valid for four years from the date your list number is established.

Can a candidate who has had psychotherapy in the past become a NYPD Police Officer?

Will a candidates psychological past keep the NYPD from hiring them? The NYPD does not automatically disqualify a candidate for having received psychological counseling or other forms of mental health treatment. However, they will carefully review the facts regarding a candidate’s mental health history and consider each and every detail. Here are a few tips to not let your psychological past stop the NYPD from hiring you.

If a candidate has a history of mental health issues, they should be prepared to answer questions about their past. They will be questioned in detail about their psychological, mental health diagnoses and past or current treatment(s) (including therapy they underwent and/or medications they were prescribed).  Candidates should also be ready, willing and able to provide all of the details, circumstances and symptoms regarding their mental health history, and how these details, circumstances and symptoms have affected them both currently and in the past. Based on the information given, the NYPD will decide if they will continue the hiring process with a candidate.

The Oral Psychological Interview – How to Succeed

The oral psychological interview is a make-or-break moment in the NYPD appeal process. This post will provide you with valuable insights on how to succeed in the interview, ensuring that you leave a lasting positive impression.

You should go into your Oral Psychological Evaluation with the expectation that it will be very stressful. If fact, this challenging environment is done by design. You must realize that you are applying for one of the most important and stressful jobs, with many unforeseen problems that can and will arise. You MUST be ready, willing and able to handle them in a quick, calm and professional manner. Your Evaluator will be making the determination as to whether or not you are capable of handling the daily challenges Police Officers face. This is based on many factors, including body language, attitude and your responses to different questions and situations. You must be prepared both physically and mentally for your Oral Psychological Evaluation.

Helpful Tips for the Interview

  • Arrive Promptly
  • Dress Appropriately
  • Have a Good Attitude

When meeting with the Oral Psychological Interview Evaluator (smile, address them by name, speak firmly and clearly, maintain eye contact, extend your hand to offer a firm handshake and when invited to sit, be sure to sit upright, not slouching). Moreover, NEVER let your Evaluator see you frustrated, angry or crying for any reason at any time. This is all part of the evaluation process to “test” your capabilities for the job. Remember, you are on a job interview, and it is your attitude, body language and responses that are being evaluated. You should present yourself as if you are already a Police Officer if you would like the Evaluator to see you as one. Finally, keep your answers short and sweet, unless your Evaluator asks you to do otherwise.

Why Was I Psychologically Disqualified?

All NYPD Candidates must go through the Psychological Evaluation process, and some will receive a psychological disqualification. There are many reasons why a Candidate might receive a psychological disqualification. It could be that the NYPD Psychologist felt the candidate had psychological issues that would adversely affect their ability to effectively perform their duties. It could also be that the psychologist simply made a mistake. If a Candidate feels that they were erroneously disqualified, they should appeal their disqualification as soon as possible in an effort to get a new assessment from an independent psychologist that can give them a more accurate assessment of their psychological makeup and possibly get their disqualification decision reversed. Candidates can receive psychological disqualifications for various reasons, such as poor stress management, anger issues, racial bias or many other issues that might deem them unfit for police work.
