NYPD Psychological Disqualification Appeal Process

Candidates who fail to provide requested documents during the application process for police officer will have their file marked discontinued.  There is no appeal from a discontinued status.

Candidates that receive a NOPD or Notice of Proposed Disqualification have thirty (30) days to appeal their disqualification.

To succeed in an appeal it is best to hire an expert to assist you.  Depending on your level of interest in this job, the investment may pay off over the long run if your appeal is successful.

Throughout my 18 years of experience as a civil service disqualification appeals attorney, I have helped many clients win their appeal. I can help you too.

New York City Civil Service Commission Appeals

If you are disqualified from a New York City job, such as painter, electrician, computer specialist or any other job, you can appeal.

Often your first appeal will be to the Committee on Manifest Errors- CME. If the CME denies your appeal, your next appeal would be to the New York City Civil Service Commission. You must create specific, fact based arguments with precise details such as dates, times, agencies or departments and tasks performed to satisfy the experience portion of experience and educations positions. Vague or incomplete information will result in a disqualification.

If you receive a notice to appeal to the CME or NYC Civil Service Commission, please feel free to contact us to discuss your case.

NYPD Psychological Appeals- One Chance to Choose Expert and Obtain NYPD Records

Law Office of Kevin P. Sheerin

I am a NYPD disqualification appeals lawyer with more than 18 years of experience. I have been assisting disqualified NYPD candidates who have received either a Notice of Proposed Disqualification (NOPD) for psychological reasons or a Final Notice of Disqualification (NOD) for psychological reasons from the NYPD.

On the Notice of Proposed Disqualification letter the candidate is given an opportunity to select an expert and have the NYPD psychological file sent to that expert for review and the preparation of a rebuttal report.  If the disqualified candidate does not respond to the Notice of Proposed Disqualification the NYPD psychological file will NOT be released.

It is crucial that the disqualified candidate select a psychologist familiar with the appeals process to assist them.  ONCE YOU SELECT AN EXPERT TO ASSIST YOU IN YOUR APPEAL YOU WILL MOST LIKELY NOT BE ABLE TO CHANGE YOUR CHOICE LATER.

Also, selecting a psychologist that the candidate formerly had counselling session with is a poor choice.

If you receive a Notice of Proposed Disqualification or Notice of Disqualification from the NYPD Psychological Service Division please contact me at 516 248 0040 to discuss your options.

NYPD Disqualification NOPD

The first notice you will receive when you are NYPD disqualified is a Notice of Proposed Disqualification or NOPD.  You will have 30 days to respond to this NOPD.  It is recommended that you consult with an attorney to protect your rights and make the most compelling arguments to increase your chances of getting a reversal of your NYPD disqualification.

I have been a civil service disqualification appeals attorney for more than 18 years. During that time I have helped many of my clients win their appeal. I would be more than happy to help you too.

Mr. Harvey Randall, New York State Civil Service law scholar and author of NY Public Personnel Law  https://publicpersonnellaw.blogspot.com/ mentioned that the “three looks and you’re out” is a New York City specific rule and I thank him for that correction.

The rule in New York City states:

Personnel Rules and Regulations of the City of New York

RULE IV – EXAMINATION PROCEDURES, VETERANS PREFERENCE, ELIGIBLE LISTS AND CERTIFICATION

SECTION I–GENERAL EXAMINATION PROCEDURES

4.7.4. Limitation on Certifications

No name shall be certified more than three times to the same agency head for the same or similar position unless at such officer’s request. However, only those who have been actually entitled to consideration for selection shall be charged with certification. For appointment to the position of police officer in the police, transit police, or housing police services, no name certified three times to one agency head shall be certified to another unless at such agency head’s request.
