You received a Psychological Disqualification… Now What?

If you have received a NYPD psychological disqualification, you should take action quickly, as waiting can either hinder or preclude you from appealing this decision. Most of the hiring agencies (i.e.: NYPD, NYC Corrections and Nassau County Police Department) have only a small window of time (generally between 15-30 days) for you to begin the appeal process. Why Was I Psychologically Disqualified?

All NYPD Candidates must go through the Psychological Evaluation process, and some will receive a psychological disqualification after going through such process. There are numerous reasons why a Candidate might receive a psychological disqualification. It could be that the NYPD Psychologist felt the candidate had psychological issues that would adversely affect their ability to effectively perform their duties. It could also be that the psychologist simply made a mistake. If a Candidate feels that they were erroneously disqualified, they should appeal their disqualification with the hopes of getting a new assessment from an independent psychologist that could give them a more accurate assessment of their psychological makeup and possibly get their disqualification decision reversed. Candidates can receive psychological disqualifications for such things as, poor stress management, anger issues, racial bias or many other issues that might deem them unfit for police work.

Appealing Your Psychological Disqualification

If a Candidate receives a Psychological Disqualification, they can file an appeal in an effort to have that decision reversed. Disqualification Letters are sent to Candidates via regular mail or email. A Candidate only has a small window of time to take action (usually 30 days) if they would like to appeal. If a Candidate is unsuccessful when appealing their Disqualification to the disqualifying agency, but believes that the decision issued was arbitrary or capricious, they can appeal again through an Article 78 proceeding.

If you have decided to move forward with an appeal, it is best to hire an experienced attorney who specializes in Psychological Disqualification Appeals, as this will greatly increase your chances of having your Disqualification successfully overturned.

NYPD Psychological Disqualification

As part of the NYPD screening process, Candidates are required to go through a Psychological Evaluation. As a result, Candidates are sometimes disqualified based on a response, action or some other factor which made the Evaluator decide that the Candidate is psychologically unsuitable for the position. This decision does not mean that the Candidate is somehow deemed unstable, it simply means that the Evaluator feels the Candidate does not process the necessary characteristics and skillset required to become a law enforcement officer. However, if a Candidate is disqualified as a result of this screening process, they can, and are strongly encouraged to appeal their disqualification, and hopefully, upon winning their appeal, have their Psychological Disqualification reversed.

NYPD Psychological, Medical and Character Disqualifications

Employment as a NYPD Police Officer can be one of the most rewarding occupations with many financial perks and benefits. However, becoming a member of the NYPD is not for everyone, as it requires many unique skillsets.
