NYPD Psychological Disqualification Appeal

If you received a Notice of Proposed Disqualification (NOPD), you can appeal. There are two factors that are crucial in Psychological Disqualification Appeal(s). The first is that you properly follow the appeal process. The second is the facts of your case.

It is vital that you consult with someone (both an appeals attorney and a Mental Health Professional – MHP) experienced in this type of appeals process. You Must Appeal Your NYPD NOPD Psychological Review or Case will be Dismissed

There is some confusion amongst candidates about whether they must appeal a NYPD psychological review Notice of Proposed Disqualification (NOPD).

To clarify, YES, you must appeal a psychological disqualification at the NOPD stage or your appeal will be dismissed.

The Psychological Assessment section file may only be reviewed by a licensed health care professional. Your only opportunity to have your Psychological Services Assessment section file reviewed during this administrative process will be at this time.

IF YOU DO NOT SUBMIT ADDITIONAL INFORMATION BY THESE DEADLINES, THIS PRELIMINARY DETERMINATION OF PSYCHOLOGICAL UNSUITABILITY WILL BECOME FINAL. YOU WILL NOT HAVE AN OPPORTUNITY TO HAVE YOUR FILE REVIEWED BY A LICENSED HEALTH CARE PROFESSIONAL DURING THIS ADMINISTRATIVE PROCESS AND YOU WILL RECEIVE NOTIFICATION THAT YOU HAVE BEEN DISQUALIFIED.

If you try to begin your appeal at the Notice of Disqualification (NOD) stage, as some people will advise you to do, the NYPD Legal Bureau will move to dismiss your appeal for failing to exhaust your administrative remedies and failing to have your psychological file sent to your Mental Health Professional (MHP) at the NOPD stage. Your appeal may be dismissed.

NYPD Psychological Disqualification Appeal and ADHD

If you had ADHD during your school years it is possible you will receive an NYPD psychological disqualification.  Many candidates when they were younger were diagnosed with ADHD Attention Deficit Hyperactivity Disorder. In school they may have received special education; tutoring; resource room and have been prescribed medicines by doctors.

Over time as young person’s brain matures and develops often ADHD attention deficit hyperactivity disorder is left behind. With this change often the medicines become a thing of the past. During the course of the application candidates reveal through their school records that they were diagnosed with ADHD and possibly received medicine.

Then the question becomes if I am disqualified for this diagnosis and condition should I appeal? Appeals can be successful if the ADHD is a thing of the past. Also, if the candidate has not taken medicine for a significant period of time. Candidates can prove that they are high-performing by showing the pattern that their school education through college or university and that they have successfully performed steady, satisfactory work. Chances of Reversing a NYPD Psychological Disqualification

If you are currently disqualified, you have two chances to succeed. Your first chance may occur if you end up having a positive outcome after a re-interview at the NYPD Psychological Disqualification NOPD phase. It is extremely important that you have a knowledgeable, experienced attorney and seasoned mental health professionals to help, guide and prepare you for any re-interview.

If you are unsuccessful, you do have a second chance to win with an appeal to the New York City – Civil Service Commission, who holds hearings and could rule that your disqualification was improper. Candidates have had their NYPD Psychological Disqualification reversed at the NOPD re-interview. Additionally, candidates have had their disqualifications reversed after hearings at the Civil Service Commission. However, your  disqualification will not be reversed unless you take action.
