Disqualification Appeals for NYPD, FDNY, DSNY, NYC Dept. of Corrections

Although it can be both a disappointment and a frustration receiving a disqualification letter from NYPD, FDNY, DSNY or New York City Department of Corrections you can address the issues head on by taking action, rather than giving up. One of the great parts of New York City civil service jobs is the New York City Civil Service Commission. The process of appeals has improved dramatically over the more than 18 years I have been helping disqualified candidates appeal their disqualifications.

NYPD Character Disqualification: How to Avoid One…

HONESTY!

If you have ever been arrested you must disclose that fact and confirm that your arrest appears on your APD5. You must always disclose your arrest record regardless of the disposition in your court case.

If you were ever suspended in school, you must disclose that fact. Your investigator and psychologist will ask for authorizations to find out if you ever had any school disciplines. When they get the reports from your school/college that you were suspended, you will be disqualified if you did not disclose that up front, and will most likely have an unsuccessful appeal.

If you were ever fired from a job you must disclose your termination because when the NYPD gets your Social Security lifetime history they will see exactly what jobs you had, and will ask you to explain why you were let go from certain jobs.

If you do not reveal these things upfront you will get disqualified and will not be able to explain them away.

How to Avoid a NYPD Character Disqualification

YOU MUST BE CANDID AND HONEST…

If you have been arrested you must check that your arrest appears on your APD5. Frequently, candidates give the excuse that “someone told me my arrest record was sealed”. This is not an excuse, and it will not work. If you have been arrested, you must disclose that you were arrested, and when you were arrested, no matter what the disposition in your court case.

If you were suspended in school, you must disclose that you were suspended. Your investigator and psychologist will ask for authorizations to find out if you ever had any school disciplines, and when they get reports from your SUNY school or any other college that you were suspended, you will be disqualified, and will most likely be unable to have a successful appeal.

If you were terminated from a job you should disclose your termination because when the NYPD gets your Social Security lifetime history they will see exactly what jobs you have had, and will ask you to explain why you were let go from certain jobs.

Unfortunately, if you don’t reveal these things upfront you will get disqualified and will not be able to explain them away.

Should I Appeal or Withdraw from a NYPD Notice of Proposed Disqualification (NOPD)

Frequently the question arises, should I take action and file an appeal or withdraw from a disqualification.

The answer lies in the circumstances and facts involved in your disqualification. There may be occasions when more time between incidents that caused you to be disqualified is a good idea, and you may wish to withdraw and try again later.

However, there are very few benefits to withdrawing, if your ultimate goal is to be an NYPD Police Officer. The withdrawal letter states that the next time you apply for the job the disqualification file will be used in determining your suitability.

Accordingly, you may wish to proceed with the disqualification appeal, if your ultimate goal is to be appointed to that job.

Can You Appeal an Administrative Law Judge’s Decision to Terminate Your Employment?

So I frequently get asked the question:

Are there any options when you are terminated following an administrative hearing?

The answer is yes. There is a section in the New York State Civil Practice Law and Rules known as Article 78 which allows you to file a Notice of Petition, and Petition in the Supreme Court of the County concerned, and request that a judge review the determination of termination.

One of the very important differences under New York State Education Law 3020a is a teacher would have a 10 day Statue of Limitations which runs from the day you or your attorney receives the determination.
