If You Fail the NYPD Psychological Review You Must Appeal or Your Case will be Dismissed

Law Office of Kevin P. SheerinThere is some confusion among candidates about whether they must appeal the NYPD psychological review Notice of Proposed Disqualification (NOPD). To clarify: YES, you must appeal a psychological disqualification at the NOPD stage or your appeal will be dismissed. The Psychological Assessment section file may only be reviewed by a licensed health care professional. Your only opportunity to have your Psychological Services Assessment section file reviewed during this administrative process will be at this time. IF YOU DO NOT SUBMIT ADDITIONAL INFORMATION BY THESE DEADLINES, THIS PRELIMINARY DETERMINATION OF PSYCHOLOGICAL UNSUITABILITY WILL BECOME FINAL. YOU WILL NOT HAVE AN OPPORTUNITY TO HAVE YOUR FILE REVIEWED BY A LICENSED HEALTH CARE PROFESSIONAL DURING THIS ADMINISTRATIVE PROCESS AND YOU WILL RECEIVE NOTIFICATION THAT YOU HAVE BEEN DISQUALIFIED. If you try to begin your appeal at the Notice of Disqualification (NOD) stage, the NYPD Legal Bureau will move to dismiss your appeal for failing to exhaust your administrative remedies and failing to have your psychological file sent to your Mental Health Professional (MHP) at the NOPD stage. Your appeal may be dismissed.

It is imperative that you hire the RIGHT psychologist to represent you in your NYPD Psychological Disqualification appeal. There are crucial steps you must take and questions you must ask before hiring a Mental Health Care Professional to assist you with your appeal. Kevin Sheerin has been a civil service disqualification appeals attorney for more than 19 years, and knows how to appeal a NYPD Psychological Disqualification. Over the years he has helped many clients win their appeal. He can help you too.

Appealing Failed NYPD Psychological Test – (Psychologists use California POST manual)

I represent Candidates who fail their NYPD Psychological evaluation for law-enforcement positions. If you receive a psychological disqualification, it is important to understand that the NYPD uses a variety of courses to determine a candidate’s suitability.

Some candidates say or hear from others that they failed the written psychological. The written psychological exam is only one portion of a candidate’s exam. Generally the following procedure is used to integrate the findings of the written psychological exam with the other portions of the psychological evaluation.

One of the most comprehensive screening manuals for law enforcement positions is the California Peace Officer Psychological Screening manual or POST.

It describes a five step process as follows:

  1. To determine if the written responses were inconsistent or if candidate over-reported or underreported problems.
  2. To evaluate the responses against the general population and against the Peace Officer candidate population’s responses.
  3. To evaluate the personal history from all sources. These sources could be school, work or psychological history.  To determine if the written test scores corroborate the personal history.
  4. To determine how the oral psychological observations of the interviewing psychologist compared to test scores in personal history.
  5. To take a candidate’s written scores, personal history and clinical observations to either support or oppose the candidate’s suitability for the position.

Based on the above, the psychological evaluation is more than just a written exam. There are responses on the written exam that could trigger strong concerns for a candidate’s suitability. More often though it is the combination of written testing, personal history and the in-person oral psychological interview taken together and evaluated together that determine a candidate’s suitability.

How to Appeal Failed NYPD Psychological Test

New York Civil Service Attorney Law Blog | Law Offices of Kevin P. Sheerin

If you failed your NYPD Psychological Test and received a Notice of Proposed Disqualification (NOPD), you have the right to appeal. There are two crucial factors when appealing a Psychological Disqualification. The first is that you properly follow the appeal process. The second is the facts of your case.

It is vital that you consult with seasons professionals (both an appeals attorney and a Mental Health Professional – MHP) who are highly qualified and experienced in this type of appeals process. It is never a good idea to appeal a NOPD on your own, as doing so may cause you to leave out some crucial arguments that could help to turn the appeal in your favor.
