The first is following the appeal process. The second is the facts of your case.

It is vital that you consult with someone experienced in this appeals process. Appealing the NOPD on your own may cause you to miss out on opportunities to make crucial arguments that can turn the appeal in your favor.

HERE ARE JUST A FEW OF THE MANY CHARACTER DISQUALIFICATION SUCCESS STORIES I HAVE ACHIEVED FOR MY CLIENTS:

N.Y.P.D. POLICE CANDIDATE WAS DENIED DUE TO HIS DRIVING RECORD –
The Applicant was a NYPD Police Candidate. Due to his active status in the military, the candidate was unaware he had infractions on his driving record and could not resolve them immediately due to deployment. I presented this case in front of the New York City Civil Service Commission and established that when Appellant became aware of the infractions, he reported them consistently and credibly. After further consideration, the Commission reversed the disqualification.

NASSAU COUNTY CORRECTIONS OFFICER WAS DISQUALIFIED FOR BACKGROUND REASONS –
A Corrections Officer candidate was denied by The Nassau County Civil Service Commission because of his failure to finish school, as well as his prior private employment issues and arrest record. I represented the client and put together a compelling argument stating that the candidate had turned his life around and worked very hard to get to where he is today despite past circumstances out of his control. After reviewing the appeal argument, the Commission rescinded their disqualification for the Applicant.

3 1/2 Hour 2nd Psychological Interview Resulted in Reversal of NYPD Disqualification

One of my clients was recently called to a second psychological interview with the NYPD.

The interview lasted 3 1/2 hours.

What can you take from this?

One, is that these interviews and processes are not taken lightly. If that were true, the psychologist would not have spent 3 1/2 hours with the candidate and would not have been that thorough and complete when questioning the candidate who had appealed their disqualification.

Two, is that this is a very serious matter, and the NYPD psychologist wanted to be sure before approving the candidate. 

Three, is that the NYPD is increasing it’s hiring and is looking for candidates to appoint, so they will thoroughly cover every topic of concern in their interviews.

The candidate was successful and was informed by the NYPD that they had passed the interview and would be returned to processing for entry into the Police Academy.

Accordingly, I would recommend that if you receive a disqualification, you seriously consider appealing the psychological interview. As always, it’s not going to get worse, as you are already disqualified. Due to increased hiring and future scheduled police academy classes, the NYPD looks at candidates who appeal as people that have a strong desire to be a Police Officer. When you pursue an appeal, you are letting the NYPD know that you are willing to invest your time and make a case that you are suitable for policing.

BE CAREFUL when hiring a Psychologist to help with your appeal…

Part of the appeal process for psychological disqualification is finding a psychologist who will help you, and make the strongest arguments for your candidacy. If the psychologist is unable or unwilling to look at your good points, strengths, adversities you’ve overcome, accomplishments, perseverance over hardships, and persistence in improving despite any difficulties or disabilities you may have had, then you should look for a different psychologist. The psychologist you hire should be on your side, advocating for you. Before you choose a psychologist to assist you with your disqualification appeal, ensure that you have an agreement with them, that if they don’t believe you are qualified, they will let you know beforehand, and they will not forward their report to any hiring agency, such as the NYPD, stating that you are psychologically unsuitable.

Beware of psychologists who charge you a very low fee, tell you they will help you and then do a superficial interview, as they may simply use the NYPD’s testing to confirm that you are unsuitable, and then send a report to the NYPD stating that you are unsuitable, without ever telling you. If this happens, not only did they not help you, but they have destroyed any chance you had of ever becoming a NYPD officer.

You should make a clear agreement with any psychologist you hire that they will discuss their findings with you before sending any report to the NYPD.

The psychologist you are considering MUST understand that they are supposed to be advocating for you, and if they don’t believe you are suitable, then they should let you know that they cannot support your candidacy, AND FURTHER AGREE that they will not forward any report to the NYPD if they come to such a conclusion.

If this does happen, at least you will have an opportunity to find someone else that is willing to help you and support your appeal.

Appeal of NYPD Disqualification/Civil Service Disqualification

NYPDDaubman v Nassau County Civ. Serv. Commn., 195 AD2d 602 (2nd Dept 1993):

• The applicant, a police officer, applied for a position with the police department and passed the requisite examinations. The commission determined that the applicant was disqualified from eligibility based on an X-ray that revealed the presence of a back condition. The commission’s physician speculated that the condition could render the applicant more susceptible to a serious disability if he suffered a future back injury.
• The court held that the commission unlawfully discriminated against the applicant based on his mere membership in a class of persons with the same condition instead of on an individualized assessment of his particular abilities.
• The court held that the determination was arbitrary and capricious because it was premised upon speculation regarding possible future disability rather than fact or concrete medical evidence that the applicant was rendered unfit to perform his duties as a result of his condition.
• On appeal, the court granted the applicant’s petition, annulled the determination of the commission, and reinstated the applicant to the status of an eligible candidate for the position of police officer with the county.
• The court stated that there was no showing petitioner’s condition rendered him incapable of performing in reasonable manner activities involved in being a police officer. Furthermore, the court held that the Commission’s determination was premised solely upon speculation regarding possible future disability, and the record contains no concrete medical evidence demonstrating petitioner would likely be rendered unfit to perform police duties in the future as a consequence of his condition. Most importantly, the court decided that the Commission’s determination was arbitrary and capricious because it was premised upon speculation rather than fact.
