Civil Service Job Disqualification NYPD (Psychological Disqualification) & FDNY (Medical Disqualification)

When you receive a civil service job disqualification such as a NYPD Psychological Disqualification or a FDNY Medical Disqualification it is crucial that you meet with a civil service law attorney to discuss your case.

Law Office of Kevin P. Sheerin

An attorney who is knowledgeable in the area will be able to explain to you the three steps to the appeal process. The attorney will be able to get your background, history and complete story of your application process, any interaction you may have had with the hiring agency’s interviewers and discuss with you the best way to approach an appeal.

This is best done in person. This time will be spent reviewing documents and discussing your life, education, work history and any jobs you may have had. It is also good to discuss what happened during the application process, whether it be background, medical or psychological. After discussing all of the facts, you can decide if you would like to act.

It is always best to communicate, get all the facts, discuss the strategy and decide if you would like to take action. Sometimes deferring to another test or looking at other jobs may be the best advice.

For more than 18 years, I have been helping civil service job candidates file their appeals, along with advising them whether or not their appeal may be successful.

Get the Facts Before You Complete Your APD5

The best advice you can receive if you want to become a NYPD police officer is to get your Certificates of Disposition for any arrests or summonses you may have received, as well as your Lifetime Abstract from New York State Department of Motor Vehicles before you complete your Applicant Processing forms.

If you guess about any arrests, moving violations or summonses you may have, you will receive a Notice of Proposed Disqualification (NOPD) stating that you are disqualified for “Omission of Pertinent Facts.”

The NYPD or other hiring agency, such as the NYC Department of Correction or FDNY have access to all of this information and when you submit an incomplete and/or inaccurate form they will compare it to their computer printouts and disqualify you.

Crucial to Check Your Email Inbox for NOPD and NOD Notices from NYPD

Candidates may have an overflowing inbox with 25, 50 or 100 emails a day.  If you miss a Notice of Proposed Disqualification (NOPD) email for a NYPD psychological disqualification or a Notice of Disqualification (NOD), and you do not respond within 30 days, your appeal may be dismissed.

Candidates may claim, “I never got it!”, but evidence can be submitted showing the day, date and time the email was sent.

The best advice is to check your email inbox and spam folder very carefully every day, because failure to do so can prevent you from getting appointed to the job, after spending 40-50 hours in applicant processing.

Another tip may be to set up an email filter to have your email provider separate the emails into a separate folder.

Case dismissals are occurring more frequently, and close attention is required to prevent bad results.

Can you get an attorney to help you with a NYPD Notice of Proposed Disqualification?

Law Office of Kevin P. Sheerin

Can you get an attorney to help you with a Notice of Proposed Disqualification (NOPD) from the NYPD?

The simple answer is yes.

The NYPD has recently started interviewing psychologically disqualified NYPD Police Officer candidates who received a NOPD, after the candidate was evaluated by an independent psychologist and their psychologist submitted an expert report on their behalf.

If you hire an attorney to prepare you for the upcoming NOPD interview, your chances of being successful greatly increase.  Many times these interviews can morph into interrogations, but the proper preparation can help you handle any harsh questioning.

No one can criticize you for speaking with someone prior to an oral psychological interview.

I would recommend hiring a civil service attorney from the first disqualification you receive, so you are prepared and can get the best results in your appeal.

Throughout my more than 18 years of experience as a civil service disqualification appeals attorney, I have helped many of my clients win their appeal. I can help you too.
