Rights of Disqualified NYPD Candidates

DCAS is New York City’s personnel department. DCAS has delegated the task of investigating applicants to the NYPD. You can appeal your NYPD disqualification. Applicants who are disqualified from appointment may challenge an agency’s findings on the grounds that such findings were made in bad faith or were arbitrary and capricious.

There are three potential appeals:

  1. NOPD – Notice of Proposed Disqualification. Based on NYS Civil Service Law 50(4) a hiring agency must give a disqualified candidate an opportunity to provide explanations for a proposed disqualification in writing.
  2. NOD – Notice of Disqualification. A disqualified candidate can appeal a disqualification to the Civil Service Commission.
  3.  If the disqualification is upheld by the Civil Service Commission the candidate can file an Article 78 lawsuit in the New York State Supreme Court in the County concerned.

Factors Considered in NYPD Character Disqualifications

When appealing a NYPD character disqualification, what are some factors being considered?

Frequency of violations or infractions, such as arrests, moving violations or other incidents such as school discipline or work discipline.  If you were suspended or expelled from school, these factors would work against your NYPD Police Officer application. Also, if you were late or disciplined at your job, this would be a problem in your application.  If you were terminated from one or more jobs without a good explanation this also would be something you would have to explain.

Severity of violations or infractions. If you were arrested and charged with crimes such as, felonies or misdemeanors, that would be something you would have to explain on appeal. If the disposition or final outcome of your case was dismissal or a lesser charge that could help you in your appeal.

The recency of your last violation or infraction is also important regarding your NYPD character appeal. If it has been a decade or even five years since your last infraction that could help you by showing the New York City Civil Service Commission that you have changed your behavior for the better.

The three categories do not stand alone – they are considered together in your appeal.

Should You Appeal a NYPD Disqualification?

Some of the most frequent questions I receive:

Should I appeal my Civil Service job disqualification?

Well, consider what happens to your chances of being a law enforcement officer if you let your disqualification stand.

Most law enforcement agencies are required to conduct an investigation for every exam you take. But how authentic will it be?

Possibly not so in depth because the person doing the investigation or testing will have in the back of their mind that you were already disqualified by another agency.  They may try to piggyback on that decision.

So your chances of ever being in law enforcement are severely damaged by your failure to take action to fight your disqualification. By fighting your disqualification the situation never gets worse – it can only get better. That is, the disqualification could get overturned.

Agencies will even use the fact that you did not appeal your disqualification against you and say that you did not even appeal last time you were disqualified, which they imply shows that the disqualification was proper.  They do not say that you didn’t appeal because you didn’t have the funds, time, energy, were a student, were living out of the country or were in the armed forces.  They only state that you were disqualified and did not appeal.
