NYPD Psychological Appeals – One Chance to Appeal if you Fail the Psych Test

What to do if you fail the NYPD Psych Test

In the event you fail the NYPD Psychological Test you will receive (by email) a Notice of Proposed Disqualification stating that you are psychologically disqualified from the NYPD Police Officer title. You have thirty days from the date of the NOPD to appeal. For a successful outcome, you should hire both an attorney and a psychologist who are experienced in the appeal process and who will help you file a rebuttal report. This report will be sent to the NYPD Candidate Assessment Division for review.

After your psychologist’s report is reviewed you may receive an email directing you to come in for another interview with a NYPD psychologist. During the interview the psychologist will review the reports prepared by both the original NYPD psychologist and your expert. You can expect to be questioned on any inconsistencies between the reports and the problem areas found by the first NYPD Psychologist who chose to disqualify you. This re-interview is an important step in the appeal process which should not be taken lightly. Be sure to hire a seasoned Attorney and Mental Health Professional who are experienced in this type of appeal process.

There is a two step appeal process:

The first step in the appeal process is to appeal to the NYPD, who will review the appeal package you submit. In the case of psychological disqualifications you may get a second psychological interview. If you receive a second psychological interview it is best to prepare with an expert. The main issues that will come up in the second psychological interview are obvious.

The next step in the appeal process would be a Notice of Disqualification (NOD) which would be appealed to the NYC Civil Service Commission. The Commission holds hearings to determine if your disqualification was improper.

When you are disqualified, that disqualification will not be reversed unless you choose to take action. I have been assisting disqualified NYPD, FDNY, DSNY, NYC DOC candidates for more than 18 years. Each appeal is different, just as your history of school, work and personal relationships are different.
