The purpose of this Manual is to provide consistency in the conduct of psychological evaluations and the criteria used by psychologists, both within and across law enforcement agencies. However, beyond compliance with POST regulations, there is no intent to impose a rigid standard of practice or otherwise infringe on the freedom of agencies to provide for the conduct of evaluations according to their respective needs and resources, or to preclude legitimate professional differences among psychologists. Rather, the guidance offered here is intended to provide a solid basis for conducting job-related, lawful, valid, effective and efficient evaluations.

While it is common to blame any peace officer misconduct act on the psychological evaluation, one must remember that, like all assessments, peace officer psychological screening is not a perfect science. Decision errors may occur, including both false positives (candidates incorrectly deemed psychologically unsuitable) and false negatives (candidates incorrectly deemed psychologically suitable). The Manual discusses such limitations in an attempt to offset the inflated expectations of hiring authorities and the public.

Although the Manual provides guidance regarding pertinent employment laws and their impact on psychological screening, the information is not intended nor should it be treated as legal advice. Agencies and psychologists are strongly encouraged to work in close consultation with their legal counsel.

Should I Appeal or Withdraw from a NYPD Notice of Proposed Disqualification

Whether or not you should appeal or withdraw from a disqualification depends on the circumstances and facts involved in your disqualification.

Sometimes allowing more time to pass between incidents that caused you to be disqualified in the first place may be a good idea. In this type of situation, you may want to withdraw for now and try again later.

However, there are very few benefits to withdrawing, if your ultimate goal is to become a NYPD Police Officer. The withdrawal letter states that the next time you do apply for the job, the disqualification file will be used to determine your suitability.

So if your ultimate goal is to be appointed to that job, you may want to proceed with your disqualification appeal without delay.

When you are disqualified, that disqualification will not be reversed unless you take action. I have been assisting disqualified NYPD, FDNY, DSNY and NYC DOC candidates for many years. Each appeal is different, just as your history of school, work and personal relationships are different.

Increasing NYPD NOPD Appeal Success at Second Interview

There has been a sharp increase in the percentage of candidates appealing their NYPD NOPD psychological disqualification, and subsequently succeeding at a second interview.

But, before you can get a second interview you must appeal your disqualification.

NYPD NOPD Disqualifications

A Notice of Proposed Disqualification (NOPD) is the first notice you will receive when you are NYPD disqualified.  You have 30 days to respond/appeal to a NOPD.  It is wise to consult with an attorney to protect your rights and make the most compelling arguments to increase your chances of getting a reversal of your NYPD disqualification.

NYPD Psychological Appeal – 1 Chance to Choose an Expert & Obtain NYPD Records

With more than 18 years of experience as a NYPD disqualification appeals lawyer I have helped many disqualified candidates who have received either a Notice of Proposed Disqualification (NOPD) or a final Notice of Disqualification (NOD) for psychological reasons from the NYPD.

The NOPD letter provides the candidate with an opportunity to select and hire their own psychological expert and have the NYPD psychological file sent to that expert for review and preparation of a rebuttal report. However, in order for the NYPD psychological file to be released, the disqualified candidate MUST first respond to the NOPD.

It is crucial, as a disqualified candidate, that you select a psychologist familiar with the appeals process. ONCE YOU SELECT AN EXPERT TO ASSIST YOU IN YOUR APPEAL YOU WILL MOST LIKELY BE UNABLE TO SWITCH EXPERTS LATER.

Also, selecting a psychologist that you formerly had counseling session with is a poor choice.
