Disqualification for High Blood Pressure Overturned

Nassau County Police Officer candidate failed to meet the Municipal Police Training Council standard for blood pressure and was disqualified in August 2013. The candidate suffered from White Coats Syndrome which is an elevated blood pressure in a clinical setting. The candidate had no history of hypertension with his primary physician. The Nassau County Civil Service Commission agreed to recheck the candidate’s blood pressure and found it to be within the MPTC standards. Candidate’s disqualification was overturned in October 2013.

Reinstated Teacher must follow DOE Chancellor’s regulations to retain tenure

Petitioner was a teacher of catering who resigned to take a chef’s position. Petitioner returned to a different school and was given a “U” rating and terminated. Petitioner filed an Article 78 petition without filing a grievance claiming that his termination was arbitrary and capricious, an abuse of discretion and violated his right to have a hearing pursuant to Education Law 3020(a). The Court of Appeals upheld the denial of the Article 78 petition ruling that the Petition was required to submit a written request to withdraw his resignation and submit to a medical exam at the direction of the school chancellor.

What are some of the reasons a candidate can receive an NYPD psych disqualification?

What can be expected in the NYPD psych testing process?

The NYPD will give you a written exam consisting of hundreds of questions. After the examination is scored you will be called to meet with a NYPD Psychological staff member for an oral psychological interview.

You may be asked questions about your answers given on the written exam and you will be asked to explain your answers.

You will be asked questions about:

Education History

Work History

Driving History

Arrest History (if any)

Psychotherapy or medicines taken

Family and Relationships

Other relevant topics

You will be asked to explain any issues that arise in the above topic areas.

You may be asked to provide authorizations for the Psychologist to get documents from schools or jobs and you will have to provide to them to complete the process.

You may receive notice that you have been placed on psychological review. This review can take some time as other members of the NYPD team review your file.

Thereafter, you may receive a Notice of Proposed Disqualification or NOPD stating that you have 30 days to appeal.

Plaintiff Failed to Comply with County Law 52 – Case Dismissed

Plaintiff claimed improper termination from respondent County and alleged protection under civil service law section 75 – be the public sector whistleblower law.

Plaintiff failed to file a notice of claim as required by County law section 52 and defendants moved to dismiss this improper termination case was granted. New York State general municipal law section 50 – the and 50 – I apply to cities and not counties. County law section 52 applies to city cases and there is a broader requirement to file a notice of claim.
