You Must Appeal Your NYPD Psychological Review NOPD or Your Case will be Dismissed Later

There is some confusion among candidates about whether they must appeal a NYPD psychological review Notice of Proposed Disqualification (NOPD). To clarify: YES, you must appeal a NYPD NOPD psychological disqualification at the NOPD stage or your appeal will be dismissed. The Psychological Assessment section file may only be reviewed by a licensed health care professional. Your only opportunity to have your Psychological Services Assessment section file reviewed during this administrative process will be at this time. IF YOU DO NOT SUBMIT ADDITIONAL INFORMATION BY THESE DEADLINES, THIS PRELIMINARY DETERMINATION OF PSYCHOLOGICAL UNSUITABILITY WILL BECOME FINAL. YOU WILL NOT HAVE AN OPPORTUNITY TO HAVE YOUR FILE REVIEWED BY A LICENSED HEALTH CARE PROFESSIONAL DURING THIS ADMINISTRATIVE PROCESS AND YOU WILL RECEIVE NOTIFICATION THAT YOU HAVE BEEN DISQUALIFIED.
If you try to begin your appeal at the Notice of Disqualification (NOD) stage, as some people will advise you to do, the NYPD Legal Bureau will move to dismiss your appeal for failing to exhaust your administrative remedies and failing to have your psychological file sent to your Mental Health Professional (MHP) at the NOPD stage. Your appeal may be dismissed.

Factors Considered in NYPD Character Disqualifications

When appealing a NYPD character disqualification, what are some factors being considered?

Frequency of violations or infractions, such as arrests, moving violations or other incidents such as school discipline or work discipline.  If you were suspended or expelled from school, these factors would work against your NYPD Police Officer application. Also, if you were late or disciplined at your job, this would be a problem in your application.  If you were terminated from one or more jobs without a good explanation this also would be something you would have to explain.

Severity of violations or infractions. If you were arrested and charged with crimes such as, felonies or misdemeanors, that would be something you would have to explain on appeal. If the disposition or final outcome of your case was dismissal or a lesser charge that could help you in your appeal.

The recency of your last violation or infraction is also important regarding your NYPD character appeal. If it has been a decade or even five years since your last infraction that could help you by showing the New York City Civil Service Commission that you have changed your behavior for the better.

The three categories do not stand alone – they are considered together in your appeal.

3 1/2 Hour 2nd Psychological Interview Resulted in Reversal of NYPD Disqualification

One of my clients was recently called to a second psychological interview with the NYPD.

The interview lasted 3 1/2 hours.

What can you take from this?

One, is that these interviews and processes are not taken lightly. If that were true, the psychologist would not have spent 3 1/2 hours with the candidate and would not have been that thorough and complete when questioning the candidate who had appealed their disqualification.

Two, is that this is a very serious matter, and the NYPD psychologist wanted to be sure before approving the candidate.

Three, is that the NYPD is increasing it’s hiring and is looking for candidates to appoint, so they will thoroughly cover every topic of concern in their interviews.

The candidate was successful and was informed by the NYPD that they had passed the interview and would be returned to processing for entry into the Police Academy.

Accordingly, I would recommend that if you receive a disqualification, you seriously consider appealing the psychological interview. As always, it’s not going to get worse, as you are already disqualified. Due to increased hiring and future scheduled police academy classes, the NYPD looks at candidates who appeal as people that have a strong desire to be a Police Officer. When you pursue an appeal, you are letting the NYPD know that you are willing to invest your time and make a case that you are suitable for policing.

Should I Appeal or Withdraw from a NYPD Notice of Proposed Disqualification (NOPD)

Frequently the question arises, should I take action and file an appeal or withdraw from a disqualification.

The answer lies in the circumstances and facts involved in your disqualification. There may be occasions when more time between incidents that caused you to be disqualified is a good idea, and you may wish to withdraw and try again later.

However, there are very few benefits to withdrawing, if your ultimate goal is to be a NYPD Police Officer. The withdrawal letter states that the next time you apply for the job the disqualification file will be used in determining your suitability.

Accordingly, you may wish to proceed with the disqualification appeal, if your ultimate goal is to be appointed to that job.
