Medical Disqualification

One of the reasons that a candidate for police officer, firefighter, or correctional officer positions may be disqualified is based upon a finding that the candidate does not meet the required physical conditions for the position based upon medical reasons.  As a result, the candidate is then medically disqualified.

If this has happened to you, it does not necessarily mean that such decision is final.  It is possible in some cases to mount a successful appeal and resume the application process.

As a medical disqualification appeals lawyer, my role is to help Candidates when possible to appeal an adverse medical disqualification decision.  I offer a free phone or video call so that I can learn about your case, and you can learn about the chances of being successful in an appeal should you desire to take this course of action.

How Can a Medical Disqualification Can Be Appealed?

The specific ways that a medical disqualification can be appealed will depend upon the exact reasons that a medical disqualification was made.

In some cases, medical devices such as hearing aids can be used to overcome a physical disability.  In other cases, such as with asthma, an underlying condition that may have affected a candidate when they were younger may no longer be a limiting condition as an adult.

An important factor for overcoming a medical disqualification will usually be to work with an independent medical professional such as a physician to prove that the medical condition can be overcome in accordance with any physical requirements that may be applicable to the position.  In other words, meaning that you are physically fit to perform all job requirements.
