NYPD Disqualification Appeal

NYPD Disqualification Appeal

NYPD Disqualification – NOPD80+ Google Reviews for the  Law Firm of Kevin P. Sheerin

NYPD Disqualification Appeal…

To appeal an NYPD disqualification, the process typically involves submitting a written request for review to the Civil Service Commission (CSC) within 30 days of the disqualification notice. You’ll need to include a copy of the disqualification notice and any supporting documentation. The CSC will review the case and decide whether to reinstate you. If reinstated, the NYPD has a 30-day period to accept or appeal the decision.

Here’s a more detailed breakdown:

Receive Notice of Disqualification (NOD):
You’ll receive a letter or email informing you of the disqualification, which will also include instructions for filing an appeal.

Gather Supporting Documentation:
Collect any relevant documents or evidence that may support your appeal.

CSC Review:
The CSC will review your case, considering the disqualification grounds and any supporting evidence you’ve provided.

Decision by CSC:
The CSC will determine whether your disqualification should be overturned and you should be reinstated.

NYPD Response:
If the CSC decides in your favor, the NYPD will have 30 days to accept or appeal the CSC’s decision.

Potential Reinstatement:
If the NYPD accepts the CSC’s decision, you will be reinstated to the eligible list and can continue with the hiring process.

Article 78 Action (if necessary):
If the CSC decision is not in your favor, you may be able to file an Article 78 action in the New York State Supreme Court. This lawsuit allows you to challenge the CSC’s decision.

Important Considerations:

Time Limit:
It’s crucial to act quickly and meet the 30-day deadline for filing an appeal.

Legal Counsel:
Consider consulting with an experienced NYPD disqualification appeal attorney who can guide you through the process and help you prepare a thorough, complete and compelling appeal.  Kevin P Sheerin has 22 years of experience assisting disqualified NYPD candidates.

Psychological Disqualifications:
If you were disqualified for psychological reasons, you may need to obtain a separate psychological evaluation from a licensed psychologist to support your appeal.

File Appeal with CSC:
Within 30 days of receiving the final Notice of Disqualification, submit a written request for review to the CSC, according to NYC.gov
