If you have been arrested you must check that you have been arrested on your APD5. Frequently, candidates give the excuse that someone told me my arrest was sealed. This will not work. If you have been arrested you must state you were arrested and when you were arrested no matter what the disposition in your court case.

If you were suspended in school you would have to say you were suspended in school. Your investigator and psychologist will ask for authorizations to find out about school disciplines, and when they get reports from your SUNY school or another college that you were suspended you will be disqualified, and will most likely be unable to have a successful appeal.

If you were terminated from a job you should say you were because when the NYPD gets your Social Security lifetime history they will see what jobs you have had and you have to explain why you were let go from certain jobs. Unfortunately, if you do not reveal these things, you will be disqualified and will not be able to explain them away. SHOULD I APPEAL OR WITHDRAW FROM NOTICE OF PROPOSED DISQUALIFICATION ………..(NOPD)

Frequently the question arises should I take action and file an appeal or withdraw from a disqualification.

The answer lies in the circumstances and facts involved in your disqualification. There may be occasions when letting more time pass between incidents that caused you to be disqualified is a good idea, in which case you may wish to withdraw and try again later.

There are very few benefits to withdrawing if your ultimate goal is to be a NYPD Police Officer. The withdrawal letter states that the next time you apply for the job, the disqualification file will be used in determining your suitability.

Accordingly, you may wish to proceed with the disqualification appeal if your ultimate goal is to be appointed to that job.

NYPD Character Disqualification

Factors considered in NYPD Character Disqualifications:

When appealing a NYPD character disqualification what are the factors considered?

Frequency of violations or infractions, such as arrests, moving violations or other incidents, such as school discipline or work discipline. If you were suspended or expelled from school this would work against your NYPD Police Officer application. Also, if you were late or disciplined at your job this would be a problem in your application. If you were terminated from one or more jobs without a good explanation this also would be something you would have to explain.

Severity of violations or infractions. If you were arrested and charged with crimes, such as felonies or misdemeanors, that would be something you would have to explain on appeal. If the disposition or final outcome of your case was a dismissal or lesser charge, that could help you in your appeal.

The recency of your last violation or infraction is also important in your NYPD character appeal. If it has been a decade or even five years since your last infraction that could help you, as it shows the New York City Civil Service Commission that you have changed your behavior for the better.

The three categories do not stand alone – they are considered together in your appeal.
