NYPD DISQUALIFICATION – ELIGIBLE LIST EXPIRATION – CALL THE DCAS HELPLINE ………. 212-669-1357

IF YOU RECEIVED A NYPD DISQUALIFICATION, CALL THE DCAS HELPLINE AT 212-669-1357 TO FIND OUT WHEN YOUR  ELIGIBLE LIST EXPIRES.

If you are in the hiring process for a New York City Civil Service job, and would like to find out when your eligible list expires:

Dial 212-669-1357
Press 2
Enter your social security number

The DCAS help line will tell you when your list was established and when it will expire. The expiration date is usually 4 years after the list was established or promulgated.

If you received a NYPD Disqualification letter, you will probably need one (1) year to process your appeal and, if you succeed, be appointed to the NYPD. Therefore, you should write to your investigator and request that action be taken on your file to allow yourself sufficient time to appeal if you are disqualified.

If you have questions or would like to schedule a free consultation at my Mineola office, please do not hesitate to call me at 516 248 0040.

NYPD Character Disqualification Factors

This video (click here) will help you understand the NYPD Character Disqualification Factors. What can offset background disqualifications? NYPD Character disqualifications can be appealed after receipt of NOPD or NOD notifications.

If you have been arrested you must check that you have been arrested on your APD5. Frequently, candidates give the excuse that someone told me my arrest was sealed. This will not work. If you have been arrested you must state you were arrested and when you were arrested no matter what the disposition in your court case.

If you were suspended in school you would have to say you were suspended in school. Your investigator and psychologist will ask for authorizations to find out about school disciplines, and when they get reports from your SUNY school or another college that you were suspended you will be disqualified, and will most likely be unable to have a successful appeal.

If you were terminated from a job you should say you were because when the NYPD gets your Social Security lifetime history they will see what jobs you have had and you have to explain why you were let go from certain jobs. Unfortunately, if you do not reveal these things, you will be disqualified and will not be able to explain them away. Is it Worth Appealing a Notice of Proposed Disqualification (NOPD)?

It’s not going to get any worse. You are currently disqualified. It can only get better. You have two chances to succeed. You could win at a re-interview at the NOPD (Notice of Proposed Disqualification) phase. It is always important to have qualified and experienced mental health professionals and attorneys to help you, guide you and prepare you for any re-interview.

If you are unsuccessful, you have an appeal to the New York City Civil Service Commission which holds hearings and may rule that your disqualification was improper. This is a second chance to win. Naysayers and critics may claim that no one ever wins, but this is not true. Recently candidates have had their disqualification reversed at the NOPD re-interview. Additionally, candidates have had their disqualifications reversed after hearings at the Civil Service Commission. But, your disqualification will not be reversed if you do not take action.

If you receive a NYPD NOPD psychological disqualification, do not hesitate to call (516) 248-0040 or email kevin@sheerinlaw.com to schedule a free in office consultation.

YOU MUST APPEAL NYPD PSYCH NOPD OR YOUR CASE WILL BE DISMISSED LATER

There is some confusion among candidates about whether they must appeal a NYPD psych NOPD (Notice of Proposed Disqualification).

To clarify, you must appeal a NYPD NOPD psychological disqualification at the NOPD stage or your appeal will be dismissed.

The Psychological Services Assessment section file may only be reviewed by a licensed health care professional. Your only opportunity to have your Psychological Services Assessment section file reviewed during this administrative process will be at this time.

IF YOU DO NOT SUBMIT ADDITIONAL INFORMATION BY THESE DEADLINES, THIS PRELIMINARY DETERMINATION OF PSYCHOLOGICAL UNSUITABILITY WILL BECOME FINAL. YOU WILL NOT HAVE AN OPPORTUNITY TO HAVE YOUR FILE REVIEWED BY A LICENSED HEALTH CARE PROFESSIONAL DURING THIS ADMINISTRATIVE PROCESS AND YOU WILL RECEIVE NOTIFICATION THAT YOU HAVE BEEN DISQUALIFIED.

If you try to begin your appeal, as many people would advise you at the NOD stage, the NYPD Legal Bureau will move to dismiss your appeal for failing to exhaust your administrative remedies and failing to have your psychological file sent to your Mental Health Professional (MHP) at the NOPD stage. Your appeal may be dismissed.

NYPD Psychological NOPD 2nd Interview

If you receive a Psychological Notice of Proposed Disqualification (NOPD) from the NYPD, you have 30 days to decide whether or not you would like to appeal.

If you do not take action, this disqualification will most likely affect your chances of being hired by other law enforcement agencies.

The good news is that the NYPD has begun a second psychological interview or a NOPD interview for some candidates that choose to appeal.

This second interview occurs at a different location and with a different psychologist from the first NYPD doctor that interviewed you. Based on the initial doctor’s interview and your expert or MHP – mental health professional’s report, this interview with a different NYPD psychologist has led to many people successfully getting their Psychological Disqualification reversed before having to appeal to the Civil Service Commission. This is very good news for candidates, as you may succeed by appealing your original NOPD disqualification.
