The above video explains the NYPD psychological disqualification appeal process, and the steps you must follow to help you succeed. It outlines the NYPD psychological Notice of Proposed Disqualification (NOPD) steps, followed by what you should do if you receive a Notice for a 2nd interview. It further explains what you should do if you receive a Notice of Disqualification (NOD), which can be appealed to the NYC Civil Service Commission.

Should I Appeal or Withdraw from a NYPD Notice of Proposed Disqualification (NOPD)

Law Office of Kevin P. Sheerin

Frequently the question arises, should I take action and file an appeal or withdraw from a disqualification.

The answer lies in the circumstances and facts involved in your disqualification. There may be occasions when more time between incidents that caused you to be disqualified is a good idea, and you may wish to withdraw and try again later.

However, there are very few benefits to withdrawing, if your ultimate goal is to be a NYPD Police Officer. The withdrawal letter states that the next time you apply for the job the disqualification file will be used in determining your suitability.

Accordingly, you may wish to proceed with the disqualification appeal, if your ultimate goal is to be appointed to that job.

Crucial to Check Your Email Inbox for NOPD and NOD Notices from NYPD

Law Office of Kevin P. Sheerin

Candidates may have an overflowing inbox with 25, 50 or 100 emails a day.  If you miss a Notice of Proposed Disqualification (NOPD) email for a NYPD psychological disqualification or a Notice of Disqualification (NOD), and you do not respond within 30 days, your appeal may be dismissed.

Candidates may claim, “I never got it!”, but evidence can be submitted showing the day, date and time the email was sent.

The best advice is to check your email inbox and spam folder very carefully every day, because failure to do so can prevent you from getting appointed to the job, after spending 40-50 hours in applicant processing.

Another tip may be to set up an email filter to have your email provider separate the emails into a separate folder.

Case dismissals are occurring more frequently, and close attention is required to prevent bad results.

Can you get an attorney to help you with a NYPD Notice of Proposed Disqualification?

Can you get an attorney to help you with a Notice of Proposed Disqualification (NOPD) from the NYPD?

The simple answer is yes.

The NYPD has recently started interviewing psychologically disqualified NYPD Police Officer candidates who received a NOPD, after the candidate was evaluated by an independent psychologist and their psychologist submitted an expert report on their behalf.

If you hire an attorney to prepare you for the upcoming NOPD interview, your chances of being successful greatly increase.  At times, these interviews morph into interrogations, and proper preparation can help you handle any harsh questioning.

No one can criticize you for speaking with someone prior to an oral psychological interview.

I would recommend hiring a civil service attorney from the first disqualification you receive, so you are prepared and can get the best results in your appeal.

Throughout my more than 18 years of experience as a civil service disqualification appeals attorney, I have helped many of my clients win their appeal. I can help you too.
