NYPD Psychological Disqualification – 2nd interview

Law Office of Kevin P. Sheerin

The NYPD re-interviews candidates who receive NYPD psychological disqualifications.  This re-interview most often occurs at NYPD Psychological Services in East Elmhurst.

The only way to get a re-interview is by appealing your NYPD psychological NOPD within 30 days.

If your goal is to become a police officer, you must do considerable homework before filling out any forms, meeting with any investigator or attending any psychological evaluation.

Below is a video describing the NYPD disqualification appeal process. Please call 516-248-3494 to schedule a free consultation to discuss your history, the oral interview and the 3 step appeal process.  You can also email me at kevin@sheerinlaw.com.

I have been a civil service disqualification appeals attorney for more than 18 years, and I have extensive experience regarding how to appeal a NYPD Disqualification. Over the years I have helped many clients win their appeal. I can help you too.

Is it Worth Appealing a Notice of Proposed Disqualification (NOPD)?

It can’t get any worse…

If you are currently disqualified, it can only get better. You have two chances to succeed. First, you could win at a re-interview at the NYPD Psych Disqualification Notice of Proposed Disqualification phase. It is extremely important that you have knowledgeable, experienced mental health professionals and attorneys to help, guide and prepare you for any re-interview.

If you are unsuccessful, you have a second chance to win with an appeal to the New York City – Civil Service Commission, which holds hearings and may rule that your disqualification was improper. Naysayers and critics will claim that no one ever wins, but that is not true. Many candidates have had their NYPD Psych Review disqualification reversed at the NOPD re-interview. Additionally, candidates have had their disqualifications reversed after hearings at the Civil Service Commission. However, your disqualification will not be reversed if you do not take action.

NYPD Psychological Disqualification Appeal Process

Candidates who fail to provide requested documentation during the NYPD application process will have their file marked discontinued.  Understand, there is no appeal from a discontinued status.

Candidates who receive a Notice of Proposed Disqualification (NOPD) have thirty (30) days to appeal their disqualification.

Disqualifications for civil service jobs – medical, psychological and character

There are 3 main types of disqualifications for civil service jobs – medical, psychological and character.

Medical

Reason: Fail the medical examination.

There are many reasons why candidates can be medically disqualified. Any physical disability that would make it difficult to perform the duties of the position applied for would be grounds for disqualification. This would include minor problems with hearing or vision as well as more major issues involving the respiratory or cardiovascular systems.

Psychological

Reason: Fail the written or oral psychological examination.

There are two components to the psychological exam – written and oral. You can fail either one of these portions and be disqualified. If you receive a psychological disqualification you will need a second opinion from another psychologist. This doctor will need to interview you, review the records from the department you applied to, and then write a report giving their professional opinion of your fitness to serve as a civil servant.

Character

Reason: Fail the background check.

On the DCAS website they set forth the following list of concerning factors that may disqualify a candidate from the NYPD:

The following are factors which would ordinarily be cause for disqualification:

  • Conviction of an offense which indicates lack of good moral character or disposition towards violence or disorder, or which is punishable by one or more years imprisonment.
  • Repeated convictions of an offense which indicates disrespect for the law.
  • Discharge from employment as a result of poor behavior or inability to adjust to discipline.
  • Dishonorable discharge from the United States Military.
  • Conviction of an offense for Domestic Violence Misdemeanors.
  • A Felony.
  • Statutory Disqualification (disqualified by law).

NYPD Psychological Appeal – 1 Chance to Choose an Expert & Obtain NYPD Records

Law Office of Kevin P. Sheerin

With more than 18 years of experience as a NYPD disqualification appeals lawyer I have helped many disqualified candidates who have received either a Notice of Proposed Disqualification (NOPD) or a final Notice of Disqualification (NOD) for psychological reasons from the NYPD.

The NOPD letter provides the candidate with an opportunity to select and hire their own psychological expert and have the NYPD psychological file sent to that expert for review and preparation of a rebuttal report. However, in order for the NYPD psychological file to be released, the disqualified candidate MUST first respond to the NOPD.

It is crucial, as a disqualified candidate, that you select a psychologist familiar with the appeals process. ONCE YOU SELECT AN EXPERT TO ASSIST YOU IN YOUR APPEAL YOU WILL MOST LIKELY BE UNABLE TO SWITCH EXPERTS LATER.

Also, selecting a psychologist that the candidate formerly had counselling session with is a poor choice.

I have extensive experience regarding how to appeal a NYPD Disqualification. Over the years I have helped many clients win their appeal. I can help you too.
