BE CAREFUL when hiring a Psychologist to help with your appeal…

Part of the appeal process for psychological disqualification is finding a psychologist who will help you, and make the strongest arguments for your candidacy. If the psychologist is unable or unwilling to look at your good points, strengths, adversities you’ve overcome, accomplishments, perseverance over hardships, and persistence in improving despite any difficulties or disabilities you may have had, then you should look for a different psychologist. The psychologist you hire should be on your side, advocating for you. Before you choose a psychologist to assist you with your disqualification appeal, ensure that you have an agreement with them, that if they don’t believe you are qualified, they will let you know beforehand, and they will not forward their report to any hiring agency, such as the NYPD, stating that you are psychologically unsuitable.

Beware of psychologists who charge you a very low fee, tell you they will help you and then do a superficial interview, as they may simply use the NYPD’s testing to confirm that you are unsuitable, and then send a report to the NYPD stating that you are unsuitable, without ever telling you. If this happens, not only did they not help you, but they have destroyed any chance you had of ever becoming a NYPD officer.

You should make a clear agreement with any psychologist you hire that they will discuss their findings with you before sending any report to the NYPD.

The psychologist you are considering MUST understand that they are supposed to be advocating for you, and if they don’t believe you are suitable, then they should let you know that they cannot support your candidacy, AND FURTHER AGREE that they will not forward any report to the NYPD if they come to such a conclusion.

If this does happen, at least you will have an opportunity to find someone else that is willing to help you and support your appeal.

Factors Considered in NYPD Disqualification

When appealing a NYPD character disqualification what are the factors considered?

Frequency of violations or infractions, such as arrests, moving violations or other incidents such as school discipline or work discipline. If you were suspended or expelled from school this would work against your NYPD Police Officer application. Also, if you were late or disciplined at your job this would be a problem in your application. If you were terminated from one or more jobs without a good explanation this also would be something you would have to explain.

Severity of violations or infractions. If you were arrested and charged with crimes that are felonies or misdemeanors that would be something you would have to explain on appeal. If the disposition or final outcome of your case was dismissal or a lesser charge that could help you in your appeal.

The recency of your last violation or infraction is also important to your NYPD character appeal. If it has been a decade or even five years since your last infraction that could help you by showing the New York City Civil Service Commission that you have changed your behavior for the better.

The three categories do not stand alone – they are considered together in your appeal.

As a civil service appeals attorney with more than 18 years of experience, I have helped many NYPD candidates win their appeal. I can help you too.

NYPD DISQUALIFICATION -FOR ELIGIBLE LIST EXPIRATION CALL DCAS

If you are in the hiring process for a New York City Civil Service job and would like to find out when your eligible list expires:

Dial 212-669-1357
Press 2
Enter your social security number

The DCAS help line will tell you when your list was established and when it will expire. The expiration date is usually 4 years after the list was established or promulgated.

If you received a NYPD Disqualification letter you will probably need one (1) year to process your appeal and hopefully succeed in your disqualification appeal to be appointed to the NYPD. Therefore, you should write to your investigator and request that action be taken immediately on your file to allow yourself sufficient time to appeal if you are disqualified.

What are the Rights of Disqualified NYPD Candidates?

DCAS is New York City’s personnel department. DCAS has delegated the task of investigating applicants to the NYPD. You can appeal a NYPD disqualification. Applicants who are disqualified from appointment may challenge an agency’s findings on the grounds that such findings were made in bad faith or were arbitrary and capricious.

There are three potential appeals:

NOPD – Notice of Proposed Disqualification. Based on NYS Civil Service Law 50(4) a hiring agency must give a disqualified candidate an opportunity to provide explanations for a proposed disqualification in writing.

NOD – Notice of Disqualification. A disqualified candidate’s next appeal is to the Civil Service Commission.

If the disqualification is upheld by the Civil Service Commission the candidate can file an Article 78 lawsuit in the New York State Supreme Court in the County concerned.

If you received a Notice of Proposed Disqualification (NOPD) in your email inbox you can appeal.
