There has been a sharp increase in the percentage of candidates appealing their NYPD NOPD psychological disqualification, and subsequently succeeding at a second interview.

Law Office of Kevin P. Sheerin

But, before you can get a second interview you must appeal your disqualification.

It’s good to get the facts before you act.

I am available for a phone consultation, a zoom conference or FaceTime. We can discuss the facts of your history, the appeal process for NOPD appeals (“step one”), including what occurred in the oral psychological interview, tips and tactics and how to avoid the traps in a second interview, the process for filing an appeal with the New York City Civil Service Commission if you do not succeed at step one, how to present the best case to get a hearing before the commission and how to succeed at a hearing before the commission.

Psychological Disqualification Appeals

If you were disqualified as a candidate for a law enforcement or other civil service position for psychological reasons, the first thing you should do is hire an experienced and qualified disqualification appeal lawyer, who thoroughly understands the appeal process and will examine your particular case to determine whether or not you have grounds for a  psychological disqualification appeal. In addition, you will need to hire a Mental Health Professional who will evaluate you and then negate any negative findings reported by the NYPD psychologist. The Law Offices of Kevin P. Sheerin can also assist you with this task, as Mr. Sheerin works with several psychologists who specialize in this area of forensic psychology.

There are many reasons why a candidate might be psychologically disqualified, including issues brought to light during the psychological evaluation process, such as arrest history, driving record, employment history, disciplinary issues in school, alcohol and/or drug or other substance misuse/abuse, interpersonal history, educational history, mental health history, prior psychological prescription drug use and psychological test results.

Should I Appeal or Withdraw from a NYPD Notice of Proposed Disqualification

Law Office of Kevin P. Sheerin

Whether or not you should appeal or withdraw from a disqualification depends on the circumstances and facts involved in your disqualification.

Sometimes allowing more time to pass between incidents that caused you to be disqualified in the first place may be a good idea. In this type of situation, you may want to withdraw for now and try again later.

However, there are very few benefits to withdrawing, if your ultimate goal is to become a NYPD Police Officer. The withdrawal letter states that the next time you do apply for the job, the disqualification file will be used to determine your suitability.

So if your ultimate goal is to be appointed to that job, you may want to proceed with your disqualification appeal without delay.

When you are disqualified, that disqualification will not be reversed unless you take action. I have been assisting disqualified NYPD, FDNY, DSNY and NYC DOC candidates for many years. Each appeal is different, just as your history of school, work and personal relationships are different.

Reasons a Candidate May Receive a NYPD Psychological Disqualification

What can be expected in the NYPD psychological testing process?

The NYPD will give you a written exam consisting of hundreds of questions.  After the examination is scored you will be called to meet with a NYPD Psychological staff member for an oral psychological interview.

You may be asked questions about your answers given on the written exam and you will be asked to explain your answers.

Law Office of Kevin P. Sheerin

You will be asked questions about:

Education History
Work History
Driving History
Arrest History (if any)
Psychotherapy or medicines taken
Family and Relationships
Other relevant topics

You will be asked to explain any issues that arise in the above topic areas.

You may be asked to provide authorizations for the Psychologist to get documents from your schools or jobs, and you will have to provide to them to complete the process. You may receive notice that you have been placed on psychological review.  This review can take some time as other members of the NYPD team review your file.

Thereafter, you may receive a Notice of Proposed Disqualification or NOPD stating that you have 30 days to appeal.

When you are disqualified, that disqualification will not be reversed unless you take action. I have been assisting disqualified NYPD, FDNY, DSNY and NYC DOC candidates for many years. Each appeal is different, just as your history of school, work and personal relationships are different.
